3. Purposes and legal bases of processing

 

We process personal data that we receive from you in the course of our business relationship. Relevant data includes, for example, name, address, phone number, email address.

  • If we obtain consent from the data subject for processing personal data (e.g., sharing data), Art. 6(1)(a) GDPR serves as the legal basis.

  • When processing personal data necessary for the performance of a contract to which the data subject is a party, Art. 6(1)(b) GDPR serves as the legal basis.

  • If processing personal data is necessary to fulfill a legal obligation that our company is subject to (e.g., commercial and tax retention requirements according to Commercial Code and Tax Code), Art. 6(1)(c) GDPR serves as the legal basis.

  • If processing personal data is necessary to protect the legitimate interests of our company or a third party and the interests, fundamental rights, and freedoms of the data subject do not override those interests, Art. 6(1)(f) GDPR serves as the legal basis for processing.

 

This includes activities such as improving business processes, developing products and services, advertising and marketing (unless objected to by you), asserting legal claims and defense in legal disputes, prevention and investigation of crimes, ensuring IT security and operations.

 

4. Recipients or categories of recipients of personal data

 

Your personal data will be processed within the company by authorized persons to fulfill our contractual and legal obligations. We only disclose your data if required by law, with your consent, or if authorized to do so.

Possible recipients include:

  • processors (e.g., IT services or accounting)

  • authorities when there is a legal obligation

  • third parties outside the company (e.g., carriers, delivery services) to fulfill our contractual obligations.

There is no active transfer of personal data to a third country or international organization

6. Duration of storage of personal data

 

Your data will be stored with us only until the purpose is fulfilled and beyond that only as required by statutory retention periods e.g.,

  • according to Commercial Code (HGB)

  • Tax Code (AO) for compliance with commercial and tax retention obligations (10 years)

  • Civil Code (BGB) for preservation of evidence within statutory limitation periods (3 years, up to 30 years).

    If you exercise these rights, we will verify if the legal requirements are met.

You also have the right to lodge a complaint with the competent supervisory authority; in Baden-Württemberg this is the State Commissioner for Data Protection.

8. Right to withdraw consent

 

If you have given consent for processing your data through a declaration, you can revoke it at any time for future processing without affecting prior lawful processing based on consent.

9. Right to object against processing for direct marketing purposes

 

In some cases we process your personal data for direct marketing purposes. You have the right to object at any time against such processing for marketing purposes.

10. Obligation to provide data

 

In our business relationship you must provide personal data necessary for establishing and conducting a business relationship and fulfilling associated contractual obligations or those we are legally obligated to collect. Without this information we may not be able to enter into or execute contracts with you.
